Dalbar is an industry leader in research and quantitative analysis of investor behavior. Dalbar has developed a national "Registered Fiduciary" certification program. In their certification Dalbar has incorporated the requirements for compliance with existing laws and regulations.

 

There are two categories of requirements:

 

 
  • ERISA (Employee Retirement Income Security Act) and the PPA.
  • SEC regulations related to the Investment Advisers Act of 1940.

 

The Registered Fiduciary™ designation, supported by The Foundation for Fiduciary Studies, restricts its use to actual fiduciaries screened for entry. It identifies financial professionals that have met the necessary requirements to serve in the important new role of Fiduciary Adviser. RF™ designation professionals are identified as having met the highest fiduciary standard in the financial industry. The RF™ designation is continuously being updated to reflect the most recent regulatory and technology changes.

 

Advantage to Plan Fiduciaries


Dalbar’s SEC NO ACTION LETTER permits an advisor to be pre-qualified if certain requirements are met.  In the absence of a qualified third-party providing the required information a plan sponsor is required to conduct a background check, conduct an assessment of the advisors experience, investigate their past record of service, financial results and knowledge.


The Dalbar certification process obtains and verifies all of the required information on behalf of plan fiduciaries and provides the necessary disclosures required under the PPA. This relieves the plan sponsor of the task of obtaining and verifying the disclosures on their own.
